My wife is older than me. She has made a will, I haven’t. Our total assets are about £250,000. If we both die together at the same time does our estate go to:
1. Those named in her will because she’s made one & I haven’t.
2. My next of kin because I’m younger
3. Neither of these, in which case please elaborate.

I hadn’t realized it varied by country. Thanks to the US contributors but I should point out I am a UK citizen, therefore I guess the answer should be what happens under UK law.

What does a Personal Representative of an estate settlement do? Are they the ones that cuts the checks from an estate settlement? Or does the lawyer do that?

e.g. You are about to put an offer on a house so you ask the estate agent what offers have been pt down already. Can they make this up to prevent you from putting a low offer in?
